Court: Thirsty Thief Faces 90 Days in Jail, Would-Be Prostitute and Accomplice Reject Deal

Here's a look at what happened during Port Chester Court's Sept. 16 session. Court is in session every Monday, Thursday and Friday.

A Greenwich man will likely be sentenced to 90 days in county jail for stealing beer and wine from a Putnam Avenue restaurant.

Russell Kazmierczak, 55, was arrested July 19 after police found him in the back of Pasquale Restaurant sipping from a cold bottle of wine. A window screen had been snipped open, and a case of beer and bottles of wine sat on the ground below the window.

Despite that day's 95-degree heat, Kazmierczak originally claimed that he had passed by and found the beer and wine sitting on the ground, still cold. But police also discovered a pair of pliers and two knives - perfect for ripping open a window screen.

Kazmierczak was charged with felony burglary, as well as misdemeanor possession of burglar's tools and criminal possession of stolen property.

On Thursday, Assistant District Attorney Grant O'Donnell announced a plea deal that will allow the thirsty thief to plead guilty to a misdemeanor charge and spend 90 days in jail. He initially faced at least one year in jail.

Judge Joseph Vita adjourned the case to Oct. 7  for sentencing.

Would-be Prostitute, Accomplice Reject Plea Offer

A Port Chester pair accused of taking $200 from a man who thought he was being propositioned for sex rejected an offer on Thursday that would have landed them with five years of probation.

According to police, 21-year-olds Garelle Pearson and Kafele Carty followed the victim down Midland Avenue on the night of June 28. At one point, the victim said, Carty stopped to speak to another woman. Pearson then approached the victim and lured him into an alley behind Dunkin Donuts, where she offered him sex for cash. Carty surfaced, roughed the man up and took $200 before fleeing.

On Thursday the Assistant District Attorney said his office wanted both suspects sentenced to five years of probation. The pair scoffed at the deal, and their attorneys rejected it.

The case was adjourned to Sept. 20, when a trial date could be set.
